Definitory Elements
The general terms and conditions will apply to all sales of goods and services by N&C TURISM SRL and its partners through the website www.hotelcubix.com to the visitor and may be modified only with the express written consent of both parties.
Thus, the following terms will mean:
Buyer – person, firm, company or other legal entity reserving a room.
Seller – the commercial company N & C TURISM SRL, with registered office in Brasov, Bdul. Saturn nr. 47, Brașov, or any of its partners.
Goods and Services – any product or service to be provided by the Seller, to the Customer.
Intellectual Property Rights (hereafter IPR) – all intangible rights such as know-how, copyright and rights in the nature of copyright, database rights, design rights, design rights, model rights, patents, trademarks and domain name registrations for any of the above.
Specifications – all specifications and/or descriptions of the Goods and Services.
Contractual Documents
By launching an electronic or telephone reservation on the aforementioned website, the Buyer agrees to the form of communication (telephone or e-mail) by which the Seller conducts its operations.
If the Seller confirms the booking, this implies your complete acceptance of the terms of the booking. Acceptance of the reservation by the Seller shall be deemed finalized when there is a verbal (telephone) or electronic (e-mail) confirmation from the Seller to the Buyer, without the need for an acknowledgement of receipt from the Buyer. The Seller shall at no time consider an unconfirmed booking as having the value of a Contract.
This Contract shall come into force upon confirmation of the Reservation by the Seller. Confirmation shall be made by telephone or electronically (e-mail). The General Terms and Conditions of Sale shall form the basis of the Contract so concluded.
Extension of Seller's Obligations
a. The Seller will use its professional and technical knowledge to achieve the result stipulated in the Reservation and deliver the Goods and Services that meet the Buyer’s requirements, needs and specifications;
b. The information presented on the Seller’s websites is for informational purposes only and is subject to change by the Seller without prior notice. Also, due to considerations of space and consistency of information structure, service descriptions may be incomplete but the Seller endeavors to present the most relevant information so that the service is used within the parameters for which it was purchased;
c. Communication with the seller – can be done by interacting with the seller, posting opinions regarding the services or communicating through the addresses mentioned in the “Contact” section. Opinions or addresses that contain abusive or inappropriate language will be excluded or ignored. The seller is free to handle the information received without having to justify it.
d. In the event of an unusually high volume of traffic from an Internet network, www.hotelcubix.com reserves the right to require users to manually enter captcha validation codes in order to protect the information on the site.
Assignment and Subcontracting
The Seller may assign and/or subcontract to a third party for services related to the fulfillment of the order, with the Buyer’s prior notice and without the Buyer’s consent. The Seller will always be liable to the Buyer for all contractual obligations.

Information of any nature provided by the Buyer to the Seller shall remain the property of the Seller. It may only be used for the performance of the contract and may only be disclosed with the written consent of the Seller and after obtaining a confidentiality undertaking from the recipient.
No public statement, promotion, press release or any other form of disclosure to third parties shall be made by the Buyer with respect to the Booking without the prior written consent of the Seller.
hotelcubix.ro messages are transmitted through specialized partners approved by hotelcubix.ro. This ensures confidentiality and information security. Customer data cannot be used, nor provided to other parties.
By submitting any information or materials through this site, you grant the Seller unrestricted and irrevocable access to, use, reproduce, display, display, modify, transmit and distribute such materials or information. You also agree that the Vendor may freely use, for its own benefit, these ideas, concepts, know-how or techniques that you have sent to us through the hotelcubix.ro website. N & C TURISM SRL does not constitute you subject to any obligations relating to the confidentiality of the information sent, if the legislation in force does not provide other specifications in this respect.
By registering in the hotelcubix.ro database, the purchaser expressly consents, within the limits of the legislation in force, to be contacted by third parties: marketing service providers, other service providers; state agencies, government agencies or insurance associations, when the specific legislation provides for this; other companies with which we can develop joint programs to offer our products and services on the market, etc.
Deadlines and Penalties
If the order deadlines cannot be met, the Seller is obliged to notify the Buyer of the estimated delivery completion date. The Buyer shall have the right to claim additional damages from the Seller, where permitted by law, in the event of the Seller’s failure in whole or in part to perform the Contract in accordance with the agreed deadlines.
In case the Seller receives erroneous information related to the invoicing of the products, a new deadline for the order honoring will be set within 3 working days.
In the case of a Reservation, it can be canceled without penalty up to 24 hours in advance. A reservation may be canceled without penalty 24 hours prior to check-in. Cancellations on the day of check-in after 2:00 p.m. will be penalized with the first night’s accommodation charge for individual reservations. In the case of group reservations, the contractual terms and conditions between the parties shall be established.

Liability
The Seller shall not be liable for damages of any kind that the Buyer or any third party may suffer as a result of the Seller’s performance of any of its obligations under the Reservation and for damages resulting from the use of the Goods and Services after the accommodation and in particular for loss of the products.
The Seller shall be liable to you in the event that its sub-contractors and/or its partners of any kind involved in the performance of the Reservation fail to fulfill any of the contractual obligations.
Force Majeure
Neither party shall be liable for the non-performance of its contractual obligations if such non-performance is due to an event of force majeure. Force majeure is an unforeseeable event beyond the control of the parties and which cannot be avoided.
Applicable Law - Jurisdiction
This contract is subject to Romanian law. Any disputes arising between the organizer and the participants in the campaign will be settled amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts.
